Welcome to Maximum Cheer!
These Terms and Conditions (“Terms”) govern your use of our website, services, and products (the “Service”) provided by Maximum Cheer (“we,” “our,” or “us”). By accessing or using our Service, you agree to comply with these Terms. If you do not agree to these Terms, please refrain from using our Service.
- Acceptance of Terms
By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. We reserve the right to update or modify these Terms at any time, and such changes will be effective immediately upon posting on this page. Please review these Terms periodically to stay informed of any updates.
- Changes to Terms
We may revise these Terms from time to time to reflect changes in our practices, products, services, or for other operational, legal, or regulatory reasons. When we make changes to the Terms, we will update the “Effective Date” at the top of the page. Your continued use of our Service after such changes constitutes acceptance of the updated Terms.
- Use of Service
You may use our Service only for lawful purposes and in accordance with these Terms. You agree not to:

- Engage in any activity that may harm, damage, or interfere with the operation of our Service or other users.
- Upload or distribute harmful or unlawful content, including viruses, malware, or unauthorized advertising.
- Use any data scraping or extraction tools without our permission.
- Account Registration
To access certain features of our Service, you may be required to create an account. You are responsible for providing accurate, up-to-date information and maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.
- Intellectual Property
All content, features, and functionality of our Service, including but not limited to text, images, logos, graphics, and software, are the property of Maximum Cheer or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, distribute, or create derivative works from any of our intellectual property without prior written permission.
- Limitation of Liability
To the fullest extent permitted by law, Maximum Cheer shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, or business interruption, arising out of or in connection with your use of our Service, even if we have been advised of the possibility of such damages.
- Payment Terms
If applicable, by using our Service, you agree to pay any applicable fees, including subscription charges, transaction fees, or one-time payments. Payments due dates vary however, they are typically due at the time of service, and we may charge additional fees for late payments. All fees are non-refundable unless stated otherwise.
- Refund and Cancellation Policy
Event Fees:
If a program’s registration update, up to and including cancellation, is made more than 48 hours prior to, but less than 46 calendar days, an event, the program may be eligible for a 100% credit for a future Maximum event (less applicable schedule change fee and non-refundable non-transferable processing fees). The program must email [email protected], and confirm receipt, a minimum of 48 hours prior to the event to be eligible.
If a program’s registration update, up to and including cancellation, is made more than 45 days prior to an event, the program may be eligible for a 100% refund of fees paid to Maximum ((less applicable schedule change fee and non-refundable/non-transferable processing fees). The program must email [email protected], and confirm receipt, a minimum of 46 calendar days prior to the event to be eligible.
Spectator Fees:

- General Policy:
All Sales Final: As a general rule, all sales of spectator tickets for Maximum Cheer events are final and non-refundable. This policy applies once a ticket purchase is completed, payment has been processed, and the event(s) has occurred.

- Event Cancellations:
Cancellation by Maximum Cheer: If an event is canceled by Maximum Cheer, a full refund of the ticket price, minus any applicable, non-refundable, processing fees, will be issued. Refunds will be processed to the original payment method used at the time of purchase.

- Event Rescheduling:
Rescheduled Events: If an event is rescheduled, Maximum Cheer or associated venue may set specific refund limitations. Ticket holders should verify the new date and/or time of the event. If you are unable to attend the rescheduled event, follow Maximum Cheer’s instructions for obtaining a refund. Generally, refunds for rescheduled events will cover the face value of the ticket, excluding any processing and/or delivery fees.

- Refund Requests:
Refund Process: Approved refunds will be credited back to the original payment method (in most cases). The processing time may vary based on bank standards but generally will post in your account within seven to ten (7-10) business days. Refunds for canceled or rescheduled events will be processed according to the guidelines set by Maximum Cheer.
Refund Limitations: Policies set by Maximum Cheer may impose restrictions on the availability of refunds. Maximum Cheer is not responsible for these limitations. It is the ticket holder’s responsibility to adhere to any/all refund deadlines and instructions provided by Maximum Cheer.
Vendor Fees:
Vendor payments are non-refundable and non-transferable without prior request and agreement in writing by Maximum AND the Vendor.
MAXpass Fees:
No refunds or exchanges will be provided for any unused MAXpass’s. Once a MAXpass has been assigned to an athlete, it is that athlete’s pass for the season. MAXpass’s are not able to be reassigned once assigned (non-transferable).

- Third-Party Links
Our Service may contain links to third-party websites or services that are not owned or controlled by Maximum Cheer. We are not responsible for the content, privacy policies, or practices of any third-party websites. By using our Service, you acknowledge and agree that we are not responsible for any damages or losses arising from your use of third-party sites.
- Termination
We may suspend or terminate your access to our Service at any time, without notice, if we believe you have violated these Terms or for any other reason. Upon termination, all rights granted to you under these Terms will cease, and you must immediately stop using our Service.
- Governing Law
These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law principles. Any disputes arising out of or in connection with these Terms will be resolved in the competent courts of Florida.
- Dispute Resolution
In the event of a dispute, you agree to first attempt to resolve the issue through informal means such as mediation or negotiation. If the dispute cannot be resolved informally, it shall be settled through binding arbitration in accordance with the rules of law in Florida.
- Force Majeure
We will not be held liable for any failure or delay in the performance of our obligations under these Terms due to events beyond our reasonable control, including but not limited to natural disasters, strikes, website/system hack, outbreak of illness, technological failures, or any act of God.
- Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be deemed severable from the rest of these Terms and will not affect the validity and enforceability of the remaining provisions.
